II. Passwords and Subscription
You are required to open an account to subscribe, use, or access the YOUR4 app or any of its features or services. You will also be asked to provide a username and password for your account. You agree that we may store and use any registration data, including your username and password, you provide for use in maintaining your account. You are entirely responsible for maintaining the confidentiality and security of your password and account. You may not use the account, username, or password of someone else at any time. You agree to notify YOUR4 immediately of any unauthorized use of your account, username, or password. We shall not be liable for any loss that you incur as a result of someone else using your password, either with or without your knowledge. You may be held liable for any losses incurred by YOUR4, or its affiliates related to or controlled by YOUR4, employees, and staff due to someone else’s use of your account and password. We reserve the right to refuse registration of, or cancel an account, in our sole discretion. You may not sell or transfer your account or otherwise allow any third party to use your account for any purposes.
We will provide information on our then-current in-studio membership and subscription requirements on the Site. Features and prices are subject to change.
III. Age Requirement
You must be at least 18 years old, or the age of legal majority in your jurisdiction of residence, to register with and use the Site. However, minors may participate in live in-studio classes, provided that
a. they and their parent/guardian have signed an YOUR4 waiver and release;
b. they are at least 16 years old; and
c. their parent/guardian is on site at YOUR4’s studio at all times.
IV. Sale of Products
YOUR4 accepts orders for certain products, apparel or accessories that we may offer through the Site or in-studio. Unfortunately, availability of products cannot be guaranteed. Graphics and diagrams are for illustrative purposes only and may not accurately reflect actual product availability. Colors, styles and other variants depicted are for illustration only and are subject to change. Errors will be corrected where discovered, and we reserve the right to revoke any stated offer and to correct any errors, inaccuracies or omissions. Unless otherwise specified at the time of purchase, you must pay for products when you place the order. All products ordered from the Site will be delivered to the shipping address you provide. We reserve the right to cancel an order placed by you at any time and for any lawful reason prior to the delivery of the product(s) and the receipt of payment in full from you, provided that we will refund any fees that you prepaid for those products if we cancel. We may send an acknowledgement of receipt of your order to the email address you provide and proof of purchase information through the Site or to your email address after your payment has been processed.

No Site content may be modified, distributed, framed, copied, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, licensed, bartered, leased or sold in any form or by any means, in whole or in part, other than as expressly permitted in these Terms or as expressly authorized in writing by YOUR4.
VI. Limited License
Subject to your compliance with these Terms and solely for so long as you are permitted by YOUR4 to access and use the Site, YOUR4 grants you a limited, non-transferable, non-exclusive, revocable right and license to access and use the Site for your own personal, non-commercial purposes, a right which may not be assigned or sublicensed to anyone. This license includes the right to view content available on the Site and the right to download one copy of the application to any single device for your personal, non-commercial home use only, provided you keep intact all copyright and other proprietary notices. We make no representation that materials on or linked to from this Site are appropriate or available for use in other locations. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
XVII. Severability and Waiver
If any provision in these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. YOUR4’s failure to exercise any right or remedy available upon your breach of these Terms or the failure by YOUR4 to demand the prompt performance of any obligation hereunder, shall not be deemed a waiver of (a) YOUR4’s rights or remedies, (b) the requirement of punctual performance, or (c) any right or remedy in connection with a subsequent breach or default on your party. No waiver of any of these Terms shall be deemed a further or continuing waiver of such terms and conditions or any other term or condition.
YOUR4 may, in its sole discretion and without prior notice (a) revise these Terms, (b) modify this Site, or (c) discontinue this Site (in whole or in part) at any time. We shall post any revision to these Terms to the Site, and the revision will be effective immediately on such posting. You agree to review these Terms and other online policies posted on this Site periodically to be aware of any revisions. You agree that, by continuing to use or access this Site following notice of any revision or the posting of any revision, you shall abide by any such revision. Except as expressly provided in any particular “legal notice,” other official Site policy, or end user license agreement found on this Site, and in the case of licensees of YOUR4’s fitness program(s) any license agreement between you and YOUR4, these Terms constitute the entire agreement between you and YOUR4 with respect to the use of this Site and the content therein.

XXII. Force Majeure
Neither party shall be liable for any failure or delay in performance under these Terms (other than for delay in the payment of money due and payable in accordance with these Terms) for causes beyond the party’s reasonable control and not caused by that party’s fault, or negligence, including, but not limited to, “acts of God,” acts of government, pandemic, flood, fire, civil unrest, acts of terror, strikes or other labor problems, computer attacks or malicious acts, such as attacks on or through the internet, any internet service provider, telecommunications or hosting facility, but in each case, only if and to the extent that the non-performing party is without fault in causing such failure or delay, and the failure or delay could not have been prevented by reasonable precautions and measures and cannot reasonably be circumvented by the non-conforming party through the use of alternate sources, workaround plans, disaster recovery, business continuity measures or other means. Dates by which performance obligations are scheduled to be met will be extended for a period equal to the time lost due to any delay so caused.
